Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the Blueberry platform, including our website at blueberryapp.io, our web application, and the Blueberry Employee mobile app for iOS and Android (together, the "Services"), operated by Blueberry Inc. ("Blueberry," "we," "us," or "our").

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Who may use the Services

The Services are provided to employees, managers, and authorized administrators of organizations that have a subscription or other agreement with Blueberry. Your organization controls who receives access. You must be at least 16 years old and authorized by your employer to use the Services.

If you use the Services on a shared workplace tablet, you must follow your organization's policies for shared devices, including signing out when your session ends.

3. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify your manager or support@blueberryapp.io promptly if you suspect unauthorized access.

Information you provide (such as your name, contact details, profile photo, and workplace responses) must be accurate to the best of your knowledge and appropriate for a workplace context.

4. Acceptable use

You agree not to:

  • Use the Services in violation of applicable law or your employer's policies;
  • Access data, locations, or features you are not authorized to view;
  • Attempt to probe, scan, or test the vulnerability of the Services or bypass security controls;
  • Copy, reverse engineer, or resell any portion of the Services except as permitted by law;
  • Upload malicious code, harass others, or use the Services to infringe intellectual property rights;
  • Misuse AskBlu or other AI features to generate harmful, unlawful, or confidential content outside your role.

We may investigate violations and cooperate with your organization. We may suspend or terminate access for conduct that risks the security, integrity, or lawful operation of the Services.

5. Organization data and employer relationship

The Services are used by your employer to manage training, operations, and workplace workflows. Content, assignments, and records you create through the Services may be visible to managers and administrators at your organization according to permissions they configure.

Your organization is responsible for its own policies regarding employee data and workplace conduct. Questions about how your employer uses information collected through the Services should be directed to your employer. Privacy-related requests may require coordination with your organization; see our Privacy Policy for details.

6. AI-assisted features (AskBlu)

AskBlu and similar features generate responses based on knowledge approved by your organization. AI outputs may be incomplete or incorrect. You should verify important operational, safety, or compliance information through official sources at your workplace. Do not rely on AI responses as a substitute for manager direction, food safety procedures, or legal advice.

7. Intellectual property

Blueberry and its licensors own the Services, including software, branding, and underlying technology. Your organization's subscription grants authorized users a limited, non-exclusive right to use the Services for internal business purposes. Except for content you or your organization upload, no rights are transferred to you under these Terms.

8. Third-party services

The Services may integrate with or link to third-party services (for example, authentication providers, payment processors for organization billing, or external feedback forms). Those services are governed by their own terms and policies. We are not responsible for third-party services we do not control.

9. Updates and availability

We may update, modify, or discontinue features of the Services with or without notice. We strive to minimize disruption but do not guarantee uninterrupted availability. Maintenance, outages, or factors outside our control may affect access.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be error-free, that AI-generated content will be accurate, or that the Services will meet every operational requirement of your workplace.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEBERRY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

Our total liability for claims relating to the Services will not exceed the greater of (a) one hundred Canadian dollars (CAD $100) or (b) the amount paid by your organization to Blueberry for the Services in the twelve (12) months before the event giving rise to the claim, except where liability cannot be limited under applicable law.

12. Termination

Your access may end when your employment ends, when your organization removes your account, when your organization's subscription ends, or when we suspend access for security or legal reasons. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and may provide additional notice through the Services or by email where appropriate. Continued use after changes become effective constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Courts in British Columbia will have exclusive jurisdiction over disputes arising from these Terms, except where prohibited by law.
